These terms of use apply to your use of the 'LFRE' application (LFRE App), which is owned and operated by Large Format Retail Association Limited (ACN 131 555 612) (LFRA). Please read these terms carefully.

These terms of use outline the terms on which you can use the LFRE App, whether as a guest or a registered user. By using the LFRE App and any associated website(s) or services, you confirm that you accept these terms of you and agree to comply with them.

If you do not agree to these terms of use, you must not use the LFRE App.

About the LFRE App

LFRE is an application developed by LFRA, to provide a portal dedicated to Large Format Retail and aligned properties Changes to terms LFRA reserves the right to change these terms of use (and other terms described above) by publishing them on www.lfre.com.au without giving you notice.

Your account

Before using the LFRE App, you must create a user account by following the instructions on the screen. Your username will be the email address you provide when registering. Your username must not be inappropriate or offensive and must not infringe upon the rights of any third party. LFRA can require you to immediately change your username if LFRA thinks it is inappropriate for use in relation to the LFRE App.

To create an account, you must select a password, known only to you. Your account is non-transferable, and you must keep your account details safe and must not disclose them to any third party. Each account may be used only by the individual who created it and not by anyone else. LFRA reserves the right to terminate your account if LFRA has reason to believe that your account details are being used by anyone other than you.

Your use of the LFRE App

You are responsible for ensuring that any activities conducted by you on the LFRE App are lawful. You must also ensure that you strictly comply with these terms of use.

After registering your account, you may use the LFRE App only for its intended purposes which includes:

• viewing, creating and/or managing listings for Large Format Retail or aligned properties;
• communication with other users for the purpose of exploring or entering into property transactions; and
• providing and accessing relevant media (e.g. advertisements) related to listings.

The LFRE App cannot be used for any of the following:

• listing not containing or related to Large Format Retail;
• incorrect, misleading or inappropriate media such as photos or videos that do not depict or do not accurately or appropriately depict the property advertised in the listing;
• non-genuine or fake listings, or listings which are not properly authorised by the relevant vendor or agent;
• behaviour that is likely to mislead or deceive any user of the LFRE App. This includes any media, listing information, advertising copy, etc; or
• outdated or inaccurate listings which are not removed.

Security

When accessing and using LFRE App, you must not:

• attempt to undermine the security or integrity of LFRA's computing systems or networks or, where the LFRE App is hosted by a third party, that third party's computing systems or networks;
• use, or misuse, the LFRE App in any way which may impair the functionality of the LFRE App or impair the ability of any other user to use the LFRE App;
• attempt to gain unauthorised access to any materials, other than those to which you have been given express permission to access, or to the computer system on which the LFRE App is hosted;
• transmit, or input into the LFRE App any:
  • files that may damage any other person's computing device or software;
  • content that may be offensive; or
  • material or data in violation of any law (including data or other material protected by copyright or trade secrets which you do not have the right to use);
• attempt to modify, copy, adapt, reproduce, disassemble, decompile or reverse engineer any computer programs used to operate the LFRE App.

Intellectual Property

LFRA owns the content housed within the LFRE App. The technology and software underlying the LFRE App is owned by Amplifier Corporation Pty Limited (Amplifier) and licensed to LFRA. You may not copy, modify, or create derivative works of LFRE's content without permission from LFRA. You may not copy, modify or reverse engineer or attempt to extract the source code of the software underlying LFRE, as this software is owned by Amplifier and is subject to the following terms of use https://www.shareableapps.com/website-terms-and-conditions-of-use/.

You may not, unless expressly permitted by the Agreement, use the LFRE App, or the material contained in it (the Material), for any purpose. This includes:

• the reproduction or distribution of the Material in any material form;
• re-transmission of the Material by any medium of communication; or
• “framing" the Material with other material on any other Internet site or application.

You may not modify, copy or otherwise commercialise the layout of the LFRE App, or any computer software or code contained in the LFRE App.

Risk and liability

To the maximum extent permitted by law, LFRA excludes all liability and responsibility to you (or any other person) in contract, tort (including negligence), or otherwise, for any loss, including consequential loss, or damage resulting, directly or indirectly, from any use of, or reliance on, the LFRE App.

You agree to release, indemnify and keep LFRA and its suppliers indemnified from and against all actions, claims, costs (including legal costs and expenses), losses, proceedings, damages, liabilities, or demands suffered or incurred by LFRA arising out of or in connection with your use of the LFRE App, including third-party claims regarding content you upload or otherwise make available via the LFRE App.

LFRA cannot guarantee uninterrupted, timely, secure or error free access to LFRE App, and its operation may be interfered with by numerous factors outside of LFRA's control.

Privacy

Your privacy is very important to LFRA. For a complete description of how LFRA will use and protect your personal information, please refer to our Privacy Policy.

Restricting access

Without limiting any other rights or remedies LFRA may have, LFRA may, without notice to you and at LFRA's sole discretion, restrict your activities through the LFRE App or temporarily or indefinitely prohibit your use of the LFRE App for any reason, including if LFRA:

• believes that you have breach these terms of use in any way;
• is unable to verify or authenticate any information you provide; or
• believes that your actions may cause loss or damage to or otherwise unlawfully harm you, third parties or LFRA's related bodies corporate or affiliates, directors, employees or agents.

For security, confidentiality and privacy reasons, LFRA is not obliged to provide you with the details of any investigation that LFRA may conduct or any action which LFRA may take, in relation to your use of the LFRE App.

User-generated content

By posting or submitting any content, including but not limited to listings, images, descriptions (User Content) you grant LFRA a non-exclusive, worldwide, royalty-free, perpetual, and transferable license to use, reproduce, distribute, modify, adapt, publicly display, and otherwise exploit such User Content in connection with the LFRE App. You also warrant to LFRA that you are duly authorised to do and have obtained all necessary consents from all relevant third-parties.

LFRA reserves the right to review, monitor, edit, remove, or refuse to post any User Content at its sole discretion, without notice, for any reason.

Other legal matters

These terms of use are governed by the laws of Victoria, without giving effect to any principles of conflicts of laws. You agree to the jurisdiction of the courts of Victoria to determine any dispute arising out of these terms of use.

If any part of these terms of use is found to be void, unlawful, or unenforceable then that part will be deemed to be severed without affecting the validity and enforceability of the remaining provisions.

Large Format Retail Association Limited (ACN 131 555 612) (LFRA) respects your privacy and is committed to protecting your personal information.

1. Purpose

This Privacy Policy (Privacy Policy) sets out the kinds of personal information we collect and hold, and how we can collect, use, disclose, secure and store your personal information. This Privacy Policy also tells you how to access and amend your personal information, and how you can make a complaint if you think we have breached our privacy obligations.

If you use or access the 'LFRE' application (LFRE App) you will be deemed to have accepted and consented to this Privacy Policy.

We will update this Privacy Policy when our information handling practices change. Updates will be published on our website at www.lfre.com.au.

2. What is personal information?

In general terms, personal information is information or an opinion about a user that personally identifies individuals either directly or indirectly.

3. What personal information do we collect?

We collect and hold information which is reasonably necessary for us to provide you with access to the LFRE App. The extent and type of personal information collected will vary depending on how you interact with us. We may collect personal information for related purposes, but only if you reasonably expect us to, or consent to us doing so.

The personal information we collect about you may include:

• Personal details such as your name, contact details (email, phone number) and position
• Information about your business or your organisation, including its trading locations and LFRA membership status/category
• Photos, video, media and copyright in relation to Large Format Retail property listings, and/or your business or organisation (such as advertisements).

4. How do we collect and hold your personal information?

We collect personal information from you when:

• you create an account on the LFRE App, or fill in details in your user account;
• you upload content to the LFRE App;
• you interact with other registered users electronically on the LFRE App;
• you interact with us electronically;
• you allow the collection of your geolocation data.

5. Collection of personal information from third party websites

The LFRE App may contain external links to websites operated by third parties. If you access a third--party website from the LFRE App, your personal information may be collected by that third party website.

We make no representations or warranties in relation to the privacy practices of any third-party provider or website and we are not responsible for the privacy policies or the content of any third-party provider or website.

You are also advised that there are inherent risks in transmitting information across the internet, including the risk that information sent to or from a website may be intercepted, corrupted or modified by third parties.

6. How do we use personal information?

We will only use your personal information to fulfil the purpose for which it is collected. These purposes include the following:

• to provide and maintain the LFRE App and its contents (which may include the disclosure of personal information)
• to establish your user account, and enable you to use the LFRE App
• to contact you to provide notices, or to respond to your queries
• to undertake an internal investigation or an action that is required or authorised by law
• internal administrative purposes, including carrying out analytics and reporting

7. How do we disclose your personal information?

We may disclose your personal information to third parties in circumstances where you would reasonably expect us to disclose your information (such as via the LFRE App). For example, we may disclose your personal information to our third-party service providers, including our IT, marketing and professional service providers, where we determine it is necessary.

We may also disclose your personal details where required or authorised by law.

8. How do we protect your personal information?

We take steps to protect your personal information, including by implementing anti-virus software, fire walls, and password protection on our files and across our software and hardware. We also regularly update our storage and data systems and protections.

We will not keep your personal information for longer than we need to. In most cases, this means that we will only retain your personal information for the duration of your relationship with us unless we are required to retain your personal information to comply with applicable laws, for example record-keeping obligations.

9. Data Breaches

We will notify you as soon as possible if a data breach has occurred that involves your personal information. In those circumstances, we may tell you what has occurred, what personal information was involved, what the implications are, what you can do, and what we will do to address the breach.

10. Accessing and correcting your personal information

You may access the personal information we hold about you and to update and/or correct it. You can either do this directly by updating your user account, or by contacting us at pkelly@lfra.com.au We will respond to you as soon as practicable, and if there is a delay we will advise you in writing.
